You are asking the court to look at the decision made by a hearing officer related to a ticket you received for toll evasion on a toll road.  You must have gone through a hearing with the E-470 Transit Authority before starting a toll ticket appeal with the county court.

A toll road is usually a highway or road that is maintained (repaired, plowed, etc.) by a private company, not the state, county, or city.  These are tickets received on E-470.

Start your E-470 toll ticket appeal in the county court of the county where you received your toll ticket.  E-470 toll tickets are given in Adams County, Arapahoe County, or Douglas County.  The courthouse finder will help you find the address of the court.  If you received your ticket in Arapahoe County, the Littleton location handles toll ticket appeals.

You have 30 days from the date that the E-470 Transit Authority issues an order, or 30 days from the date of your hearing with the E-470 Transit Authority, to give your toll ticket appeal paperwork to the county court.

* You are the Defendant/Appellant .

* Follow the prompts on the form to fill in the blanks on the Notice.

(1) Decide where (which courthouse) to deliver your paperwork.

You will need to know in which county you received your E-470 toll ticket - Adams County, Arapahoe County, or Douglas County. Deliver your paperwork to the county court in the county where you received your E-470 toll ticket. The courthouse finder will help you find the address of the court.  If you received your ticket in Arapahoe County, the Littleton location handles E-470 toll ticket appeals.

(2) Give the Court the completed form.

(3) Pay the filing fee.

Pay the filing fee.  If you do not think you can afford the filing fee, go to the instructions and fill out form JDF 205 Motion to File Without Payment and Supporting Financial Affidavit and JDF 206 Finding and Order Concerning Payment of Fees to request a waiver of the filing fee. (4) Mail a copy of the Notice of Appeal and Desgnation of Record-E-470 Case to the E-470 Transit Authority, or their attorney. The address for the E-470 Transit Authority or their attorney should be on any paperwork that you received from them.

You should receive JDF 235 Notice of Record Certified to County Court-E-470 Case from the E-470 Transit Authority. This form tells you that the E-470 Transit Authority sent a copy of your toll ticket record to the county court where you filed your toll ticket appeal.

BRIEFS

* You will have 21 days after the county court receives the record from the E-470 Transit Authority to give a written Brief to the court. The Brief tells the court exactly what you want to be looked at in your appeal and the legal mistakes you believe the E-470 transit authority made, including any legal arguments and law that support what you are saying.

(1) Write a Brief

TIPS on writing a Brief

* Visit your local library, the Supreme Court Library, or a law library to look at exampes of Briefs, including Briefs related to toll ticket appeals.

* An Answer Brief form is not available. You may want to look at JDF 76 General Motion to make sure that you have a caption, are using the correct font type, and are using the correct font size on the Answer Brief that you create. C.R.C.P. 10 (Colorado Rules of Civil Procedure) includes the format requirements for briefs.

* Include both your E-470 toll ticket case number and your county court appeal case number on the Brief.

(2) Decide where (which courthouse) to deliver your Brief.

* Your appeal case is in the same county court where you filed your toll ticket appeal. The courthouse finder will help you find the correct court.

(3) Give the court the completed Brief.

(4) Mail a copy of the Brief to the E-470 Transit Authority, or their attorney.

* Write or type the word COPY on the Brief for the E-470 Transit Authority.

* Complete JDF 1313 Certificate of Service, telling the court how you provided a copy of the Brief to the E-470 Transit Authority, or their attorney.

* Give the completed JDF 1313 to the court.

The county court judge will look at the paperwork in your E-470 toll ticket appeal, including any records from the E-470 case. There may be a hearing where you may give evidence or subpoena witnesses.  The county court judge will create a written ruling or order, and you will receive a copy of the written ruling or order.
